Terms and Conditions

Warrants to the original purchaser that this product is free from defects in materials and workmanship for the period of 30 days from the date the customer purchases the item. This warranty does not apply to damage due to misuse, abuse, negligence or accident, repairs not done by us or lack of maintenance. We shall in no event be liable for death, injuries to persons or property, or for incidental, contingent, special or consequential damages arising from the use of our product. We will either repair or replace the product at our election. Warranty is not transferable. Applicable to new items only.

One Year Extended Warranty

Covers parts necessary for You to repair Your Product(s) from the date of purchase. For problems due to functional part failures unless otherwise stated below. The extended parts warranty covers defects in workmanship or materials. Standard wear parts and consumables are not covered in this extended warranty.  Extended warranty does not cover damage due to misuse, abuse, negligence or accident, improper repairs, or lack of maintenance. These type of damages may void this extended warranty.  Warranty is not transferable. Applicable to new items only.

The foregoing warranty shall not apply to any goods or parts, which have been subject to improper installation, accident, negligence, alteration, abuse or misuse. Our obligation under this warranty shall be limited to replacing, at our warehouse, any parts, within one year from the date of purchase to the ORIGINAL PURCHASER, be demonstrated to be defective. In order to accomplish demonstration of defectiveness, the parts claimed to be defective must be sent by the original purchaser to Benchmark Ltd. and include a RAN (Return Authorization Number).  Benchmark Ltd. or the manufacturer shall not be liable under any terms of this warranty if the defective part is not submitted to Benchmark Ltd. for inspection. This warranty does not extend to incidental or consequential damages of any nature. In no event shall Benchmark Ltd. be liable, in contract, tort, strict liability or under any other legal theory, for incidental, indirect, special or consequential damages, including but not limited to labour charges. In no event shall Benchmark Ltd.'s liability exceed an amount equal to the sales price. 

Title and risk of loss pass to the buyer upon Benchmark Ltd. tender of the product to the common shipping carrier.

Damaged or lost goods in transit should be promptly reported to the carrier. Any claims for loss or damage shall be the responsibility of the buyer, Any error in shipment of the material should be reported to Benchmark Ltd. immediately upon receipt of the shipment.

Any legal disputes to be resolved in Barrie, Ontario, Canada. Transportation charges to be prepaid by purchaser.
